What Are Irs Bank Levies
When the IRS attaches a levy to your bank account, you know they mean business. In short, the IRS can seize your checking and savings accounts and use the funds to satisfy your tax debt.
When that happens you feel helpless. You are facing having literally no money to live on. You are in an impossible situation, or so it feels.;
That is why I wrote this chapter. I am going to explain what an IRS bank levy is how the process works. I am also going to tell you what criteria the IRS uses for issuing a levy against your bank accounts and included a list of expenses that are exempt from the levy.;
You actually have a small window of time from the time your bank receives the notice of lien from the IRS and when the funds are released to the IRS. If you are facing an IRS bank lien, then give me a call and I will show you what we can do during those precious three weeks.

What Is A Bank Levy
When you owe a balance due to the IRS and fail to resolve that balance in a timely manner through one of the approved resolution methods, the IRS takes increasingly stern action to try and force compliance on your part. One of these avenues is through an IRS bank levy.;
An IRS levy is defined as, a legal seizure of your property to satisfy a tax debt. In the case of an IRS bank levy, the IRS takes money from your checking or savings account in order to satisfy your outstanding tax liability. Although the IRS is required to send notice of its intent to levy under statute, it usually does not tell you when it plans to seize money out of your checking account.;
Sometimes this puts taxpayers in a precarious position because they count on funds being in these accounts that are no longer available due to the IRS levy.
The IRS bank levy process is initiated by a notice sent from the IRS to the bank that is holding your assets. Usually, the IRS will only send one levy notice at a time, but they will eventually get around to sending notices to every bank where they have reason to believe that you are holding assets in.;
From this point, the bank retains the money for 21 days prior to releasing the funds to the IRS. After this 21-day period, the bank, by law, must release the funds to the IRS. No further action is required on the part of the IRS to receive funds. Taxpayers will not have access to any funds levied during this period.;
How Do I Opt Out Of The Remaining Child Tax Credit Checks
Most families who qualify for the expanded credit didn’t need to take action to receive the advance payments in 2021. If you already filed a 2019 or 2020 federal income tax return , you would have started getting the credit automatically in July. And the credit is nonrefundable, so you don’t need income to get it, and families can pocket the extra cash if the amount of the credit is higher than their total tax bill.;
The Child Tax Credit Update Portal lets you;opt out of receiving;this year’s monthly child tax credit payments. That means that instead of receiving monthly payments of, say, $300 for your 4-year-old, you can wait until filing a 2021 tax return in 2022 to receive the remainder of the $3,600. You can unenroll at any time, but you must opt out at least three days before the first Thursday of the month you’re unenrolling from . At this point,;the IRS says;unenrolling or opting out is a one-time action — and you won’t be able to opt back in until later this month. The next deadline to opt out is Oct. 4 by 9 p.m. PT .;
You may choose to unenroll from the advance monthly payment program because you’re expecting circumstances to change or if the partial monthly payments will interfere in tax planning. Families that usually owe money to the IRS when they file taxes may want to instead use the full credit next year. Or you might want a larger payout if your household is saving for a big expense.;

Prove That Releasing The Bank Levy Will Help To Pay Your Taxes
There are hardly any examples of this, so Ive left it till the end. A more common argument you might make to the IRS is that the IRS need not levy your bank account to collect on your taxes.
This would typically require you to show that you have other resources that would assist in paying off your tax debt.
While this is certainly an option, my go-to defense for any IRS collection effort is the installment agreement . Its effective, and usually does not require you to disclose much financial information.

Critics Sound The Alarm Ahead Of Possible Retroactive Capital Gains Tax Hike
If the proposal to require financial institutions to increase reporting to include account balances, inflows and outflows, is passed there is no question it will increase taxes collected. Both self-reporting and audit outcomes will likely be improved. However, defending against an IRS exam is stressful and can be costly. The Biden administration and Congress should work together to ensure that taxpayers who simply move funds between accounts are not audited solely as a result of the proposed increased financial reporting obligations for financial institutions.

Revenue From Tax Cheats Supports Build Back Betters Critical Investments
The bank reporting proposal and the broader tax compliance proposal will raise substantial revenue from tax cheats to support the investments in the Build Back Better agendainvestments in clean energy, health care, child care, education, paid leave, and many other critical areas. The overall plan includes the IRS funding as well as a key bipartisan proposal to improve oversight of paid tax preparers. Unscrupulous and incompetent preparers can get their unwitting clients in trouble with the IRS by botching their tax returns. They also may fail to claim valid tax credits or deductions on clients behalf. The National Taxpayer Advocate has urged Congress for years to authorize paid preparer regulation to establish minimum competency standardsand it is time for Congress to act.

Why Are Tax Prep Companies Getting The Stimulus Payments Instead Of The Customers
KENS in San Antonio reached out to Snapback Tax Services, which had this explanation for the confusion. A spokesperson said that when a client owes the firm a fee for filing their taxes, or if the client applies for an advance refund, a third-party bank like Metabank processes and issues the refund.
Snapback Tax Services shared an email with KENS 5 from EPS Financial, a division of Metabank, explaining the IRS erroneously sent the stimulus funds to Metabank accounts instead of sending directly to the client.
The email says, in part:
The IRS has stated that they will be sending EIP payments directly to the individual recipients. However, we have seen what appear to be EIP deposits sent from the IRS to us for around 15% of our total customer base. These payments should not have been deposited to our bank and we have set in place an automated process to return these payments quickly to allow the IRS to deliver them directly to individuals.
The email goes on to say that if a customer sees that their stimulus deposit was inadvertently sent to their temporary account with EPS, the money was sent back to the IRS.
The email then goes on to advise any client to contact the IRS.
